What Does it Mean for Florida to be a No-Fault State?

With the exception of New Hampshire and Virginia, every state in the union mandates that a driver must have insurance. Florida is one of only 12 states that has a no-fault insurance law. Simply put, the law means that when you have a car accident in the Sunshine State, your own insurance company is responsible for paying the bill, regardless of fault. No-fault insurance dates back to the 1960s when drivers, insurance companies, and law enforcement officers began discussing ways to make insurance claims less time-consuming. In the 1970s, legislation was introduced in a few states to offer no-fault insurance.

A driver in Florida must be covered for $10,000 of property damage and $10,000 for personal injury protection (PIP). Most insurance companies will recommend that you buy more. Bodily injury liability insurance will help to cover these expenses. Personal injury protection pays 80% of medical bills and 60% of time off of work.

If you have an uninsured accident in Florida, you may have your driver’s license, vehicle registration and tags suspended. Because you are in a no-fault state, you will be liable for your bills.
